IS CBD LEGAL IN THE U.S.?

WHAT COUNTRIES IS CBD LEGAL?

These are a few questions we get asked from time to time so we thought we would write a short article on the Legality of CBD Oil in America and around the World.

In this Article we will discuss the Legality currently surrounding Hemp CBD Oil products in the United States and around the Globe. Further, we will explain the 2018 Farm Bill that changed the CBD status in America. Also, we will discuss the current CBD laws in the larger Countries around the world.

IS CBD LEGAL IN THE UNITED STATES?

SHORT ANSWER: YES!

According to the 2018 Farm Bill, that was signed in December of that year by the President, changed the legality for Industrial Hemp. Before this legislation Hemp was aligned with its “cousin” plant Marijuana as a Scheduled 1 Drug. The hemp plant and marijuana plant are both varieties of the Cannabis Sativa Plant.

(They have classes/schedules of 1-5, these drugs are based on “danger” levels,)

(i.e. heroine is a 1 and cough syrup is a 5.)

Meaning, the Hemp Plant, in their eyes, was a dangerous drug with no medicinal value. We all know now how insane that was, and we could write books about how terrible that classification has been on Hemp and Marijuana. Especially, for people living in impoverished communities, as well as American financial sectors.

2018 FARM BILL

This landmark legislation was a blessing for the CBD industry and Industrial Hemp manufacturers. The bill was built upon the 2014 Farm Bill, which allowed for a heavily restricted pilot program for certain farmers to cultivate industrial hemp.

The 2018 Bill expanded the allowance for industrial Hemp production to be done more freely and with no restrictions on possessing, transporting, and selling over state lines.

Caveat:

This is legal as long as the Hemp

is cultivated with 0.3% or less of THC levels.

Furthermore, Industrial Hemp is now classified as an Agricultural product like corn or soy crops, as it should have been decades ago.

Today, all legal industrial hemp is bred to have this tiny amount of thc and usually about 30-40% of CBD in the plant as well. Conversely, marijuana plants have very low levels of CBD and 30-40% of THC in them.

So any Hemp CBD product will never get you “high”. In fact, most reputable brands will even filter out this small amount to make all the cbd oil completely thc-free.

In addition, some individual states have restrictions of their own. For example, in Idaho the CBD Oil has to be 100% THC-free. So there are a few states with minor restrictions, but rarely enforced, as common sense and education expands.

TAKEAWAYS:

  • Industrial hemp cbd oil is legal in all of America.
  • It must contain 0.3% or less of THC to be legal.
  • Anything over this amount of THC, from the hemp plant or the marijuana plant, is still illegal.
  • Most Brands will strain this fractional amount to make their products THC-Free.
  • No Worries about Hemp CBD getting you High.

WHAT COUNTRIES IS CBD CURRENTLY LEGAL

EUROPEAN UNION

Again, every Country or Territory might have some minor restrictions. I.E. 0.2 or 0.3% THC levels, but as of Today the European Union EU Industrial Hemp is legal.

  • Individual EU States control regulation and legalization of CBD themselves.
  • Most European Countries Hemp CBD Oil is legal if it contains 0.3% or less of THC.
  • CBD edibles are classified as novel food and have stricter regulations.
  • Each Country might have other “paper” restrictions put in place, but many of these are in constant change and rarely enforced. It’s best to search for your own Countries regulations regarding CBD if this is a concern.

CANADA

Under the 2018 Cannabis Act CBD from Hemp is legal, but restricted. One can grow up to four plants for personal use, and for business would need a government license. Each Province or Territory has their own regulations regarding CBD. Further, importing CBD into Canada will most likely get your products seized and destroyed at customs.

CBD CURRENTLY LEGAL:

Argentina, Austria, Belize, Bulgaria, Canada, Chile, Colombia, Costa Rica, Croatia, Cyprus, Czech Republic, Estonia, Finland, France, Georgia, Germany, Greece, Guatemala, Hong Kong, Hungary, Ireland, Italy, Latvia, Lithuania, Luxembourg, Malta, Netherlands, New Zealand, Northern Ireland, Norway, Paraguay, Peru, Poland, Portugal, Puerto Rico, Romania, Slovenia, South Africa, Spain, Sweden, Switzerland, Virgin Islands, United Kingdom, United States, Uruguay, Turkey, Japan.

CONCLUSION:

To conclude, CBD made from Industrial Hemp and under 0.3% THC is legal in America to buy, consume, and sell. Furthermore, around the world there is a lot of grey areas that still exist because it is still a relatively new market.

Most countries allow some form of it when the cbd is made from Hemp. Importing CBD from the U.S. into a foreign country is another story. Again, depends on the Country.

For example, importing any cbd product from the U.S. to Canada will most likely be seized at customs and destroyed. Other countries like Japan, it will be allowed in, if you provide a lab analysis and it is made from the hemp seeds or stalks.

So do your due diligence if you are in business or a consumer in a particular country. More often than not one is free to possess, consume, and sell hemp cbd oil.

cbd gummies

Adding CBD Gummies to your Daily Regimen

In this article we will be discussing why a user might supplement their health regimen with CBD Gummies. More importantly, we will go into detail about the legal status and biochemical makeup of CBD. Also, we will discuss the four things to look for when purchasing high quality CBD Gummies.

Why take Cannabidiol CBD?

People take CBD for a wide range of health issues, including mood, sleep, discomfort or to supplement what one doesn’t receive from their diet. CBD is not the only chemical in the plant that can influence the human body. As of today there have been 113 identified Phytocannabinoids, that are contained within the Hemp plant.

Hemp also produces a wide range of other active compounds, including flavonoids and terpenes. Hemp also contains numerous vitamins, minerals, amino acids, and omegas. Simply do a google search of “CBD” and your issue for further resources and information.

In the wake of the Coronavirus, CBD Gummies are great for a daily serving of Hemp Extract Oil. It is full of essential vitamins and minerals for your immune system and overall health. Some of these are Iron, zinc, carotene, phospholipids, phytosterols, vitamin B1, vitamin B2, vitamin B6, Vitamin D, vitamin E, chlorophyll, calcium, magnesium, sulfur, copper, potassium, phosphorus, amino acids, omegas, and enzymes.

Eating a diet that includes optimal levels of all these elements is very difficult. If your nutrition is lacking, or worse, consisting of mostly processed foods, it’s near impossible to consume healthy amounts of these essential vitamins and nutrients.

What are CBD gummies?

CBD gummies are made from the Hemp Plant and are classified as an edible that usually contain between 5mg to 30 mg of CBD. Cannabidiol (CBD) is extracted from cannabis sativa or hemp plant. The CBD is extracted from hemp plants in most Gummies and has a low concentration of the ‘hallucinating’ cannabinoid Tetrahydrocannabinol (THC) at or less than 0.3%.

This means that the hemp CBD oil doesn’t induce a “high” like marijuana. The user will be able to function just as he or she would normally do throughout the day. These cannabinoids interact with Endocannabinoid system (ECS) in humans and pets, which can be taken for sleep, mood, appetite, discomfort, and other related health and wellness issues.

As a result, CBD gummies are in high demand from reputable Hemp Oil Brands. More importantly, being digested in the stomach allows for slow absorption throughout the body over a longer period of time than a sublingual CBD oil or CBD softgel. The user can combine different transport methods when on a CBD daily regimen.

Many take gummies as a treat throughout the day, in addition to a CBD sublingual tincture oil and/or softgels. For varied absorption rates and maintaining complete body coverage through the course of the day. Most important, always keep a journal of how many milligrams mg. you are using so you will be able to ascertain your correct daily amount going forward. It typically takes a new user a week or so to achieve their correct dosage, usually by increasing a dose or two every few days until a noticeable difference is felt.

What is the Legal Status of CBD Gummies?

December 20th, 2018, President Trump signed the Farm Bill, not a new piece of legislature, but an important one especially for the Hemp industry. Hemp will now be placed under the supervision of the Department of Agriculture USDA and going forward will now be an agricultural commodity like corn or soybeans.

For decades, Hemp derived CBD oil had been listed as a Controlled Substance, alongside marijuana and other intoxicating substances. This new legislation making hemp an agricultural product will open the doors for more needed research and development, not only with hemp but derivatives such as CBD and other cannabinoids.

For Hemp CBD to be legal it has to contain 0.3% or less of the cannabinoid THC. However, CBD which is derived from marijuana plant still falls under the category of illegal substance. As per the regulations of the 2018 Farm Bill, ‘any cannabinoid—a set of chemical compounds found in the cannabis plant—that is derived from hemp will be legal, if and only if that hemp is produced in a manner consistent with the Farm Bill, associated federal regulations, association state regulations, and by a licensed grower.’

Essentially, CBD gummies derived from hemp plants are federally legal to consume because they have 0.3% or less of THC. Most reputable brands will even filter out this tiny amount to make their CBD products 100% THC Free.

How Do CBD Gummies Work?

The CBD in gummies works by boosting functions your body already performs via your Endocannabinoid System or ECS. Homeostasis is responsible for our inner balance, physiologically and even psychologically. It refers to the processes which our body employs to maintain a stable environment, even at times when we feel unstable and those processes are undesirable.

The human body has an Endocannabinoid system that works to regulate discomfort, mood, sleep, appetite, memory, and more. At times, whether from a poor western diet or the stress of the day, the Endocannabinoid system could use a little bit of additional help to continue performing at an optimal level.

That’s where CBD products come into play. They work in together with your body’s preexisting system, which people say gives them a natural boost to help them feel their best. This isn’t an artificial boost like what caffeine will do, but a natural content feeling.

Edibles are a popular choice nowadays, whether you buy ready-made options or choose to purchase CBD oil separately to create your own. They are great for slow absorption of the CBD. Expect it to take anywhere between 20 and 60 minutes to experience the effects.

For greater efficiency, eat your CBD gummies on an empty stomach which will allow a quicker absorption time. Overall, the effects tend to be milder, if taking the same mg. amount as a tincture oil, but last longer than other ingestion methods, usually around four-six hours.

quality-manufacturing Four Things When Choosing a CBD Gummy

1. U.S. Grown Organic Hemp

Hemp acts like a sponge, so anything that is in the ground the Hemp plant will soak up, i.e. heavy metals, toxins, pesticides, and pollutants. These harmful chemicals with then go into you. This obviously defeats the purpose of taking CBD Gummies for your overall health and wellness.

Many companies import their CBD from Asia or Europe where regulations and standards are much less than that of the United States. You ideally want the Company to practice their Hemp extraction and processes in a Good Manufacturing Practice (GMP) facility.

2. Third-Party Lab Tested with Viewable Reports

Secondly, you will need your CBD Oil that will go into making the Gummies to have an Independent Laboratory test, so you will know exactly what the chemical makeup of the CBD Oil is, and how much actual CBD is in it.

More Importantly, whether there are any pollutants, heavy metals, or THC in the Oil. These results should be readily available on the Company’s website. The reports should be easy to read. If not easily obtained, then it’s best to shop somewhere else.

3. How Much They Cost

Many brands utilizing imported hemp and can charge relatively low cost for what appears to be high dosage bottles of CBD Gummies. This is simply because the Hemp is of poor quality with no regulations of how the Hemp was grown, or having third-party lab testing done.

These company’s costs are minimal and can be transferred to the consumer by way of a cheap CBD product. Moreover, every reputable CBD Company has to pay more for U.S. Organic Hemp because of more stringent American regulations, Third-Party Lab testing, and other expenditures. Hence, the higher prices for these CBD Brands.

In common sense terms, there is no point to consuming a poor quality mystery hemp extract oil since one is taking it for health reasons. For example, if you see a 10,000mg CBD Gummies bottle selling on Amazon for $19.99, you can bet this is imported hemp oil if hemp oil at all, it could be hempseed oil which has no CBD in it.

So it is best to shop somewhere else. You will only get what you pay for when it comes to a high quality American CBD Oil product. Premium Grade American CBD Brands will have ballpark price points around $40-$80 for 300mg-600mg CBD Gummy bottles.

4. Ingredients

Many companies will load their Gummies with 20-30 artificial ingredients and lots of sugar. This defeats the purpose of the good nutrients that are entering your body. Always look at the label, if there is something that you can’t pronounce or have no idea what that particular ingredient is, then move on.

Look for a CBD Gummy that has 12 or fewer ingredients at most. These should primarily consist of Organic ingredients as well.
