These are a few questions we get asked from time to time so we thought we would write a short article on the Legality of CBD Oil in America and around the World.
In this Article we will discuss the Legality currently surrounding Hemp CBD Oil products in the United States and around the Globe. Further, we will explain the 2018 Farm Bill that changed the CBD status in America. Also, we will discuss the current CBD laws in the larger Countries around the world.
IS CBD LEGAL IN THE UNITED STATES?
SHORT ANSWER: YES!
According to the 2018 Farm Bill, that was signed in December of that year by the President, changed the legality for Industrial Hemp. Before this legislation Hemp was aligned with its “cousin” plant Marijuana as a Scheduled 1 Drug. The hemp plant and marijuana plant are both varieties of the Cannabis Sativa Plant.
(They have classes/schedules of 1-5, these drugs are based on “danger” levels,)
(i.e. heroine is a 1 and cough syrup is a 5.)
Meaning, the Hemp Plant, in their eyes, was a dangerous drug with no medicinal value. We all know now how insane that was, and we could write books about how terrible that classification has been on Hemp and Marijuana. Especially, for people living in impoverished communities, as well as American financial sectors.
2018 FARM BILL
This landmark legislation was a blessing for the CBD industry and Industrial Hemp manufacturers. The bill was built upon the 2014 Farm Bill, which allowed for a heavily restricted pilot program for certain farmers to cultivate industrial hemp.
The 2018 Bill expanded the allowance for industrial Hemp production to be done more freely and with no restrictions on possessing, transporting, and selling over state lines.
This is legal as long as the Hemp
is cultivated with 0.3% or less of THC levels.
Furthermore, Industrial Hemp is now classified as an Agricultural product like corn or soy crops, as it should have been decades ago.
Today, all legal industrial hemp is bred to have this tiny amount of thc and usually about 30-40% of CBD in the plant as well. Conversely, marijuana plants have very low levels of CBD and 30-40% of THC in them.
So any Hemp CBD product will never get you “high”. In fact, most reputable brands will even filter out this small amount to make all the cbd oil completely thc-free.
In addition, some individual states have restrictions of their own. For example, in Idaho the CBD Oil has to be 100% THC-free. So there are a few states with minor restrictions, but rarely enforced, as common sense and education expands.

Again, every Country or Territory might have some minor restrictions. I.E. 0.2 or 0.3% THC levels, but as of Today the European Union EU Industrial Hemp is legal.

- Most European Countries Hemp CBD Oil is legal if it contains 0.3% or less of THC.
- CBD edibles are classified as novel food and have stricter regulations.

Yes, In Australia Hemp-derived CBD Oil is legal to purchase and consume. The oil is classified as a dietary supplement and must contain 0.005% or less of THC.
No, only approved shops selling some thc-free beauty/skincare products are allowed. Nor can you buy CBD online. Ironically, China is the biggest producer of Hemp as well as exporting it.

To conclude, CBD made from Industrial Hemp and under 0.3% THC is legal in America to buy, consume, and sell. Furthermore, around the world there is a lot of grey areas that still exist because it is still a relatively new market.
Most countries allow some form of it when the cbd is made from Hemp. Importing CBD from the U.S. into a foreign country is another story. Again, depends on the Country.
